Case Law

Case law is a collection of judicial decisions in which a court applied the facts of a particular case to the law at issue. It is also referred to as legal precedent. Case law is jurisdictional, which means that a court in one state could not render a decision based upon the law from another state. Similarly, the decision made in one federal circuit is not binding upon a court in a different federal circuit.

Although those decisions are not binding, they can be persuasive and used as guidance by the deciding court. A decision by the United States Supreme Court, however, is binding on all federal courts and on state courts when a federal law or issue is involved.
